It seems like the ongoing dispute between DC Comics Batman and football club Valencia CF won’t come to an end any time soon. You would assume that Batman longtime battle would be against the Joker or any other Gotham villain; contrary to that, Batman dispute has been with Spanish football club over the use of the bat icon. After Valencia CF revealed their centenary crest, DC Comics has decided to file an objection to the trademark registration before the European Union Intellectual Property Office.
The legal battle has resurfaced after in 2014 the American publisher DC Comics went on a trademark War Against Valencia CF over the usage of the bat. DC Comics sued Valencia CF and claimed the bat in the Valencia shield was too similar to Batman. This time around DC didn’t file a lawsuit, rather a complaint against the centenary logo. They argue that the graphic work of Valencia will just confuse the audience. Similar to their previous altercation, DC hasn’t had luck winning the right to the bat. The Office for the Harmonization of Internal Market (OHIM) has given this legal battle a cooling off period of 22 months for both parties to come into a settlement. This, of course, benefits Valencia which will continue to use their centenary design throughout the year; that specific design that sparked up the battle with DC.
Although DC could presume that their logo is more recognized worldwide, Valencia has had a bat in their crest before Batman was created. In fact, the bat is closely associated with the region of Valencia, to the point that it is part of the city coats of arm. It is said that the connection between the bat and Valencia dates back to 1238 when King James of Aragon conquered the kingdom of Valencia. Legend has it that the bat landed on top of the flag and gave the Valencia side good luck to win the battle.
Valencia CF was founded in 1919 and became the bat became a central piece of their logo in 1921, 13 years earlier than the creation of Batman. Who should win this legal battle? I’ll leave it up to the (OHIM) to decide but I think DC should leave this behind and both continue to use the bat. Outside of America, football is one of the most popular sport and im pretty sure people won’t confuse these two logos. People know who Valencia CF can notice the difference between Valencia and Batman. Afterall it seems like this dispute with Valencia won’t be causing many headaches throughout their 100 year anniversary.
